Website Terms

Last updated: 1 October 2026

These terms apply to your use of the KEYPORT website. They explain how website information, Airport bookings and Vehicle Relocation quote requests relate to the applicable service arrangements.

Airport Car Concierge bookings

Airport bookings require acceptance of the separate KEYPORT Customer Service Agreement during booking and are confirmed after successful payment verification. Payment does not replace acceptance of that agreement. The service-specific agreement takes precedence for the Airport service where relevant.

The approved agreement below is version 2026-09-09-v1. It is presented for reference; reading it here does not record acceptance or create a booking. Acceptance is recorded in the Airport booking flow.

Read the Airport Customer Service Agreement

CUSTOMER SERVICE AGREEMENT & TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the provision of vehicle concierge, collection, driving, return and related services (“Services”) provided by KEYPORT (“we”, “us”, “our”) to the person making the booking (“Customer”, “you”, “your”).

By completing a booking and accepting these Terms, you enter into a binding agreement with us.

1. THE SERVICE

Our Airport Car Concierge Service allows a Customer to travel to Brisbane Airport in their own vehicle and hand the vehicle and keys to an authorised representative of KEYPORT.

Subject to the service booked, we may:

• collect the vehicle at the agreed handover location;

• drive the vehicle from the handover location to the Customer’s nominated address or another agreed location;

• temporarily retain custody of the vehicle and/or keys where expressly included in the booking;

• collect the vehicle again before the Customer’s return;

• drive the vehicle to the agreed return location; and

• return the vehicle and keys to the Customer.

The exact Services, dates, locations and charges are those shown in the Customer’s confirmed booking.

We do not provide passenger transport. Unless expressly agreed otherwise, Customers and other passengers will not be transported in the vehicle by our drivers.

2. CUSTOMER AUTHORITY

By making a booking, you confirm that:

a. you are at least 18 years old and have legal capacity to enter into this Agreement;

b. you are the registered owner of the vehicle or have full authority from the registered owner to engage us to provide the Services;

c. you authorise KEYPORT and its authorised drivers to possess, enter, start, operate, drive, park and otherwise reasonably handle the vehicle as required to perform the Services;

d. the vehicle is legally registered and roadworthy;

e. the vehicle is appropriately insured as required by law;

f. you have disclosed any relevant defect, warning light, mechanical problem, security feature, immobiliser, modified control or special operating requirement that could reasonably affect the safe operation of the vehicle; and

g. all information supplied during the booking process is accurate and complete.

You must notify us before handover if any of these statements cease to be correct.

3. VEHICLE HANDOVER

The Customer must attend the agreed handover location at the agreed time, subject to any reasonable operational instructions communicated by us.

The Customer must provide:

• the vehicle;

• a functioning vehicle key;

• any security or operating information reasonably required to drive the vehicle; and

• any other item expressly agreed as necessary for the Service.

Due to operational constraints that may apply at airport drop-off areas, a detailed joint inspection of the vehicle with the Customer may not be possible.

The Customer acknowledges and agrees that we may take photographs and videos of the vehicle at the time of handover, including while the Customer removes personal belongings and prepares the vehicle before handing over the keys.

4. VEHICLE CONDITION INSPECTION

4.1 Initial Inspection

At the time of vehicle handover, we will conduct a visual inspection of the vehicle’s condition.

The inspection may include:

• photographs of the exterior of the vehicle;

• a continuous or substantially continuous 360-degree video around the vehicle;

• photographs of individual body panels;

• photographs of wheels and rims;

• photographs of windows and windscreen;

• photographs of visible existing scratches, dents, chips, marks or other damage;

• photographs of the interior where reasonably relevant;

• a photograph or record of the odometer; and

• a record of the fuel level and relevant dashboard warning lights.

The purpose of this inspection is to create a contemporaneous record of the reasonably observable condition of the vehicle at the time of handover.

4.2 Existing Damage

Any visible damage or condition recorded during the initial inspection may be used as evidence of the condition observed at the time of handover.

This may include, without limitation:

• scratches;

• dents;

• paint chips;

• cracked or chipped glass;

• wheel or rim damage;

• bumper damage;

• stains;

• interior damage; and

• other visible cosmetic damage.

The inspection does not constitute a mechanical inspection and does not represent that every defect, mark or condition has been identified.

4.3 Customer’s Own Evidence

Customers are encouraged to photograph or video their vehicle immediately before handover.

The Customer may retain those photographs or videos as their own independent record of the vehicle’s condition.

Nothing in these Terms prevents the Customer from providing relevant evidence in connection with a genuine damage claim.

5. VEHICLE CONDITION REPORT

Following the initial inspection, we may prepare an electronic Vehicle Condition Report.

Where reasonably practicable, the report or access to the relevant photographs and videos will be sent to the email address or other electronic contact details supplied by the Customer.

The report may include:

• booking reference;

• inspection date and time;

• recorded odometer reading;

• fuel level;

• photographs and/or videos;

• existing damage identified during the inspection; and

• relevant observations.

The Customer should review the report promptly.

If the Customer believes the report contains an error or fails to record relevant pre-existing damage, the Customer should contact us as soon as reasonably practicable and preferably within 24 hours of receiving the report, providing any supporting photographs or other evidence available.

This 24-hour period is intended to allow discrepancies to be resolved promptly. It does not exclude or restrict any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

6. PHOTOGRAPHIC AND VIDEO EVIDENCE

The Customer authorises us to photograph and record the vehicle for the purposes of:

• documenting its condition;

• administering the booking;

• managing disputes or damage claims;

• supporting insurance claims;

• maintaining operational and security records; and

• establishing the condition of the vehicle while it is in our possession.

Images and videos will be used for legitimate operational, evidentiary, insurance and legal purposes and handled in accordance with our applicable privacy practices.

Where reasonably practicable, inspection media will be associated with the relevant booking, date and time.

7. VEHICLE CONDITION AT RETURN

We may conduct a further condition inspection before or at the time the vehicle is returned to the Customer.

Where a dispute arises concerning alleged damage, relevant evidence may include:

• the initial Vehicle Condition Report;

• return inspection photographs or videos;

• Customer-supplied photographs or videos;

• timestamps;

• odometer records;

• driver records;

• booking records;

• communications;

• repair assessments or quotations;

• third-party evidence; and

• any other reasonably relevant information.

No single item of evidence automatically determines liability. Claims will be assessed having regard to the available evidence and applicable law.

8. PRE-EXISTING DAMAGE

To the maximum extent permitted by law, KEYPORT is not responsible for loss or damage that existed before the vehicle came into our custody or that was not caused by our failure to exercise due care and skill in providing the Services.

This includes pre-existing scratches, dents, paint defects, wheel damage, windscreen damage, interior damage and other pre-existing defects.

Where initial inspection photographs or videos reasonably demonstrate that alleged damage was already present at the time of handover, that material may be relied upon when assessing any subsequent claim.

9. FAIR WEAR AND EXTERNAL CONDITIONS

Subject to the Australian Consumer Law and to the extent permitted by law, we are not responsible for ordinary deterioration, fair wear and tear, or loss or damage not caused by our breach, negligence or failure to exercise due care and skill.

Depending on the circumstances, this may include naturally occurring deterioration or external events outside our reasonable control.

Nothing in this clause excludes liability where loss or damage was caused by our failure to exercise the standard of care required by law.

10. MECHANICAL AND ELECTRICAL CONDITION

Our Service is not a mechanical inspection service.

Unless caused by our act, omission, negligence or failure to exercise due care and skill, we are not responsible for a pre-existing or independently occurring:

• mechanical failure;

• electrical failure;

• battery failure;

• tyre defect;

• engine or transmission fault;

• warning light;

• electronic system malfunction;

• manufacturer defect; or

• other latent or pre-existing vehicle defect.

If the vehicle becomes unsafe or incapable of being driven during the Service, we may stop driving it and contact the Customer.

Any towing, roadside assistance or repair costs will be dealt with according to the cause of the issue and applicable law.

11. PERSONAL PROPERTY

Customers should remove cash, jewellery, electronics, important documents and other valuable personal property before handing over the vehicle.

The Customer should notify us of any particularly valuable or unusual item that must remain inside the vehicle.

To the extent permitted by law, we are not responsible for loss of personal property where the loss was not caused by our negligence, breach of these Terms or failure to exercise due care and skill.

Nothing in this clause limits rights that cannot lawfully be excluded.

12. VEHICLE KEYS

We will take reasonable care of vehicle keys while they are in our custody.

Customers must provide a functioning key and disclose any known defect or special requirement associated with it.

If a key is lost or damaged as a result of our failure to exercise reasonable care, responsibility will be determined in accordance with applicable law and our insurance arrangements.

13. DRIVING THE VEHICLE

The Customer expressly authorises our authorised personnel to drive the vehicle only as reasonably necessary to provide the booked Services.

This may include reasonable travel necessary to:

• leave or reach the handover location;

• travel between the airport and the nominated address;

• park or reposition the vehicle;

• refuel or recharge the vehicle where authorised or reasonably necessary;

• respond to an emergency; or

• otherwise perform the agreed Service.

We will not intentionally use the vehicle for unrelated personal purposes.

14. FUEL AND CHARGING

The Customer must ensure that the vehicle has sufficient fuel or battery charge to complete the required journeys.

Where additional fuel or charging is reasonably required to perform the Service, we may contact the Customer and/or purchase the minimum amount reasonably required.

Any authorised or reasonably necessary fuel, charging or associated cost may be charged to the Customer where disclosed and permitted under the booking terms.

15. TOLLS, PARKING FEES AND TRAFFIC INFRINGEMENTS

The Customer is responsible for ordinary tolls and agreed parking costs arising directly from the booked Service where those charges have been disclosed as payable by the Customer.

We are responsible for fines or infringements directly caused by the unlawful conduct of our driver while operating the vehicle, except to the extent the infringement results from circumstances attributable to the Customer or vehicle, including an undisclosed registration issue or vehicle defect.

Responsibility for any disputed charge will be assessed according to the circumstances and applicable law.

16. FLIGHT DELAYS AND CHANGES

The Customer must provide accurate flight and travel information and notify us of known changes as soon as reasonably practicable.

We will take reasonable steps to accommodate genuine flight delays.

However, significant delays, changes of date, incorrect flight information or changes outside the original booking may result in additional charges where those charges were clearly disclosed or agreed.

We do not guarantee that events outside our reasonable control, including airport restrictions, road closures, extreme traffic conditions, severe weather or emergency events, will not affect timing.

17. CUSTOMER DELAYS AND NO-SHOWS

Customers must make reasonable efforts to arrive at the agreed handover or return location at the agreed time.

Where a Customer is substantially late or fails to attend, reasonable waiting or rescheduling charges may apply where those charges were disclosed before booking or otherwise agreed.

We will take reasonable steps to contact the Customer before treating a booking as a no-show.

18. CANCELLATIONS AND REFUNDS

Cancellation and refund rights will be determined according to:

• the cancellation policy displayed at the time of booking;

• these Terms; and

• the Australian Consumer Law.

Any cancellation fee must reflect the applicable booking terms and must not operate to remove rights or remedies available under applicable law.

Nothing in our cancellation policy excludes any refund or other remedy to which a Customer is legally entitled.

19. DAMAGE WHILE IN OUR CARE

We take reasonable care when handling and driving Customer vehicles.

If the Customer believes that new damage occurred while the vehicle was in our custody, the Customer should notify us as soon as reasonably practicable.

The Customer should provide:

• booking reference;

• a description of the alleged damage;

• photographs or videos where available;

• the date and time the damage was discovered; and

• any other reasonably relevant evidence.

We will review the initial and return condition records and any other relevant evidence.

Where it is established that loss or damage resulted from our negligence, breach of contract or failure to provide the Service with due care and skill, the matter will be handled in accordance with applicable law and, where relevant, our insurance arrangements.

20. DAMAGE CLAIMS

We may reasonably request an independent assessment, repair quotation or inspection before accepting or resolving a damage claim.

The Customer must take reasonable steps to prevent further damage after discovering an issue.

Neither party should undertake unnecessary repairs that materially prejudice the other party’s ability to assess a claim, except where repairs are reasonably necessary for safety, legal compliance or to prevent further loss.

Nothing in this clause restricts rights available under the Australian Consumer Law.

21. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other right or remedy that cannot lawfully be excluded, restricted or modified.

Subject to those rights and to the maximum extent permitted by law, we are not responsible for loss or damage to the extent that it:

a. existed before the Service commenced;

b. results from inaccurate, incomplete or misleading information provided by the Customer;

c. results from a vehicle defect or condition not caused by us;

d. results from the Customer’s failure to disclose a relevant known problem;

e. is caused by an event outside our reasonable control and not attributable to our failure to exercise due care and skill; or

f. is caused or contributed to by the Customer or another person for whom we are not legally responsible.

Any limitation in these Terms applies only to the extent permitted by law.

22. AUSTRALIAN CONSUMER LAW

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

Among other things, Services supplied to consumers must be provided with due care and skill and must comply with applicable statutory consumer guarantees.

Nothing in these Terms is intended to exclude, restrict or modify those guarantees.

If there is any inconsistency between these Terms and a mandatory provision of applicable consumer law, the mandatory provision prevails.

23. INSURANCE

We will maintain insurance that we reasonably determine is appropriate for the Services we provide, subject to the terms, conditions, limits and exclusions of the applicable policies.

The existence of insurance does not alter either party’s legal rights or determine liability for a particular incident.

Customers remain responsible for maintaining any insurance legally required for their vehicle and should ensure their insurance arrangements are appropriate for their circumstances.

24. ACCIDENTS AND EMERGENCIES

If an accident, breakdown or emergency occurs while we are operating the vehicle, we may take reasonable action to protect persons and property.

This may include:

• contacting emergency services;

• moving the vehicle where safe and lawful;

• contacting roadside assistance;

• arranging towing where reasonably necessary;

• contacting the Customer; and

• communicating with insurers or relevant authorities where appropriate.

We will notify the Customer as soon as reasonably practicable having regard to the circumstances.

25. PRIVACY AND PERSONAL INFORMATION

We may collect personal information reasonably necessary to provide and administer the Services, including:

• name;

• contact information;

• booking information;

• vehicle details;

• flight information;

• nominated addresses;

• photographs and videos of the vehicle;

• communications; and

• payment-related records.

Personal information will be handled in accordance with applicable privacy laws and our Privacy Policy.

Payment card information should be processed through our authorised payment provider and should not be retained directly by us except as permitted and necessary.

26. ELECTRONIC COMMUNICATIONS

The Customer consents to receiving booking-related communications electronically, including:

• confirmations;

• Vehicle Condition Reports;

• photographs or links to inspection media;

• invoices and receipts;

• operational updates; and

• notices relating to the Service.

The Customer is responsible for providing accurate contact information.

27. ELECTRONIC ACCEPTANCE

The Customer may accept these Terms electronically.

Immediately before completing payment, the Customer will be given access to these Terms and required to confirm acceptance.

Electronic acceptance is intended to have the same contractual effect as acceptance of a written agreement, subject to applicable law.

We may retain an electronic record of:

• the Terms accepted;

• the exact version of the Terms;

• booking reference;

• Customer identity and contact details;

• date and time of acceptance; and

• other reasonable technical records demonstrating acceptance.

28. COMPLAINTS AND DISPUTES

If a dispute arises, both parties should first attempt to resolve the matter reasonably and in good faith.

Customers may contact:

KEYPORT

Email: keyport.bne.au@gmail.com

We will review relevant booking records and evidence and provide a response within a reasonable period.

Nothing in this dispute process prevents either party from exercising any legal right or contacting an appropriate consumer protection body, insurer, tribunal or court.

29. CHANGES TO THESE TERMS

We may update these Terms for future bookings.

The version accepted by the Customer at the time of the relevant booking will apply to that booking unless a change is required by law or subsequently agreed by both parties.

A Customer will not be bound by a material change made after their booking merely because the Terms displayed on our website were later updated.

30. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent permitted by law or, where necessary, severed.

The remaining provisions will continue to operate to the extent legally possible.

31. GOVERNING LAW

These Terms are governed by the laws applicable in Queensland, Australia.

Subject to any rights a Customer has to bring proceedings elsewhere under applicable law, the parties submit to the jurisdiction of the courts and tribunals competent to hear disputes arising in Queensland.

32. ENTIRE AGREEMENT

These Terms, together with the confirmed booking details, applicable pricing, cancellation policy and any other document expressly incorporated into the booking, constitute the agreement relating to the booked Services.

Nothing in this clause excludes representations or rights that cannot lawfully be excluded.

CUSTOMER ACKNOWLEDGEMENT
